Haryana court imposes damages on Dream11

A couple of days ago, the District Consumer Disputes Redressal Forum of Kaithal city in Haryana imposed damages of INR 2 Lakh on India’s first gaming unicorn and the largest fantasy sports company, Dream11 for failing to its commitment of giving free contest tickets to the winner.

A consumer complaint filed by Balinder Rapria, a resident of Balu village in Kaithal who won a fantasy league contest of the Caribbean Premier League T20 on Dream11 in 2018. The contest assured Rapria that one of his family members or friends will win an all-expense trip to watch the ICC Women’s World Cup T20 in Antigua and Barbuda in November 2018.

The complainant Rapria alleged that the fantasy sports platform failed to fulfill the terms and conditions promised in the contest and did not provide the free trip. To this, Dream11 stated that it was ready to provide the all-expense trip, but Rapria had to obtain the visa. Although the company was willing to provide assistance for the trouble. Both the complainant and Dream11 exchanged calls and discussions regarding the matter.

However, the Dream11 representative defended claiming that the trouble was related to attaining a visa which at the end was rejected by the court. In fact, the sports company apologized in emails to Rapria expressing its guilt and offering a trip to an upcoming match in another country.

However, the court ruled that the failure to fulfill the trip amounted to deficiency of service and malpractice under Section 2 of the Consumer Protection Act, 1986. The bench comprising of three members of the district consumer forum instructed Dream11 to pay INR 2 Lakhs to the Rapria as damages along with 9% interest from the day of filing of the complaint and INR 5,000 as the litigation costs.
