Tamil Nadu To Pass A Fresh Legislation To Ban Online Rummy In The State

Previously, Madras High Court’s verdict called the ban on online gaming by the Tamil Nadu state government as ‘invalid.’ As per latest news reports the Tamil Nadu state government has brought a fresh legislation to ban online rummy in the state. A directive from the Chief Minister, M K Stalin led to the formation of this fresh legislation of banning online rummy in the state, said state law  minister, S Reghupathy

The opposition government, AIADMK has also asked the state to move to the Supreme Court demanding a stay on the verdict. In the statement, Reghupathy also pointed out that Stalin had demanded a ban on rummy when he was the leader of the opposition government. In November 2020, the AIADMK government, who was in power at that time, had hurriedly passed the legislation banning online rummy.

Following the ban, a petition against the legislation was moved to the Madras High Court. In a hearing held on Tuesday, the Madras High Court passed the verdict stating that the ban was invalid. The Madras High Court stated lack of clarity on why the government decided on the ban. Reghupathy said that even though the court had passed the verdict against the ban, the court did not bar the government from issuing fresh legislations. Hence, as soon as the court passed the verdict, Stalin had asked the people concerned to set-up fresh legislation with enough clarity, to ban the game in the state.

Opposing the former legislation which banned online gaming, the first bench of chief justice Sanjib Banerjee and justice Senthilkumar Ramamoorthy had said, “The legislation challenged herein has to be regarded as something done by the legislature capriciously, irrationally and without adequate determining  principles such that it is excessive and disproportionate.”

C Ve Shanmugham, the former state law minister, questioned the ruling DMK government for the negligence on its part, which led to the High Court ruling out the legislation. He said, “The AIADMK government brought in the legislation and banned online rummy, following pleas from the public, especially women, and other organizations. A few affected companies approached the court and when the case came up for hearing towards the end of April, it was postponed to June since assembly elections had been held in the state.” He claims that though the DMK government came in power in May, it did not employ the best lawyers for the case, while the online companies hired efficient lawyers for the hearing.
