Why Has Tamil Nadu Government Left Fantasy Sports Unbanned?

The Tamil Nadu state government imposed a ban on online gambling a few days ago. The ban came into action as the state reported several deaths due to online gambling. Following those incidents, the government led by Edappadi .K. Palaniswami made an announcement about banning online rummy and stating that similar games that promote online gambling levies fines and jail term for violators. The recent update in the case is that, though the ban has been imposed there seems to be a loophole in the system.

Fantasy Sports

According to the ordinance passed by Tamil Nadu, betting or wagering on games of skill virtually is not specifically an offence in the case of fantasy sports, as those applications can still be used. Several state governments have already declared Fantasy sports to be a skill game, but whether fantasy sports is indeed a game of skill is still questionable as the decision is pending from the Supreme Court. 

The hearing about this case will be further taken up in December. Due to this scenario, all eyes will be on the Madras High Court’s hearing in December where the issue of fantasy sports could be resolved. Until then, there is no specific ban on Fantasy sports in Tamil Nadu. 

Other South Indian states, mainly Andhra Pradesh and Telangana have entirely deleted the provision granting exemptions for skill games altogether and all online games that involve betting have been made illegal. Unlike the governments of Andhra Pradesh and Telangana, which has also banned fantasy cricket, the Tamil Nadu Gaming Act, 1930 has chosen to retained fantasy gaming till now. 

Card games like rummy and poker have bore the brunt of the Tamil Nadu ordinance but fantasy cricket may have found a gap between the legality issues. One can only look forward to the Supreme Court’s hearing on the same.
