Dream11 is one of the biggest fantasy sports platforms in the world. This company was started in 2008 by Bhavit Sheth and Harsh Jain and has transformed the way a sports lover interacts with their favourite games, whether it’s cricket, football, or basketball. There are millions of active players on this platform where you can create teams, compete, and win cash prizes after conducting contests based on athletes’ real-life performances. However, not all Indian states are in compliance with this platform. This article talks about the states in which Dream11 has been banned or restricted.

The 1967 Bengal Act was expanded under the Assam Game and Betting Act of 1970. This states that all kinds of betting or wagering on games or sports apart from horse racing and lotteries are illegal. The 1913 revision to the Bengal Act, which permitted an exemption based on simple skill, was not taken into consideration by the Assam Act. This is why Dream11 is restricted in the state of Assam, and players in this state are not allowed to enter cash contests as they are classified as illegal.
The definition of bet under this act reads as “bet” with all its grammatical variations means any money or valuable security or thing staked by a person on behalf of himself or on behalf of any other person, by himself or through any agent or any person procured or employed acting for or on his behalf, to be lost or won on the happening or determination of an unascertained thing, event or contingency of or in relation to a game or sport and shall include acceptance of a bet.
Odisha has banned all online gambling games under the Odisha Prevention of Gambling Act of 1955. While the fantasy sports app Dream11 is a skill-based game and is not considered gambling, it is still restricted under this act in Odisha. While Dream11 can be downloaded, people from Odisha cannot enter cash contests.
The Sec 2(b) section of this act is titled ‘Gambling or gaming’ and reads ‘, does not include lottery and means a play or game for money or other stake and includes betting and wagering and other act, game and contrivance by which a person intentionally exposes money or things of value to the risk or hazard of loss by chance.’
The Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act, 2015, recognizes the skill-based category for online gaming. Despite that, several requirements and regulations make it nearly impossible to conduct business there. Section 7 of the Act requires that a license be secured from the issuing body for gaming apps like Dream11. However, the Act is not readily accessible online, which creates problems with compliance.
The license costs Rs. 10 lahks per game per annum or Rs. 25 lahks per annum if an entity wishes to offer a range of games. The charge is doubled after three years, and the license is valid for five years. Because of the number of regulations to comply with, such as KYC guidelines, banking requirements, and foreign deposits, getting a license is not attractive for online gaming companies offering games of skill. It is due to these problems that while Dream11 is not particularly banned in Nagaland, Dream11 do not wish to conduct business in the state.

Andhra Pradesh is another state that has restricted Dream11 use. The state banned gambling activities through the Andhra Pradesh Gaming Act of 1974, which was further amended to include harsh penalties for people found guilty of gambling. The Andhra Pradesh Gaming (Amendment) Ordinance, 2020, was formed by the government of Y S Jaganmohan Reddy and prohibited any act of risking money or playing for stakes or otherwise on the results of a game or an occasion, including a game of skill.
The 2(2) section of the Andhra Pradesh Gaming Act of 1974 reads ‘”gaming” means playing a game for winnings or prizes in money or otherwise and includes playing a game of mutka or satta, 1[or playing an online game for winning money or any other stakes] and lucky board and wagering or betting, except where such wagering or betting takes place upon a horse-race –
(i) on the day on which the horse race is to be run;
(ii) in an enclosure which the stewards controlling the horse-race 2[or race meeting] have, with the sanction of the Government set apart for the purpose; and
(iii) (a) with a licensed bookmaker; or (b) by means of a totalisator; but does not include a lottery;’
Sikkim has some very awkward acts that impose restrictions on Dream11 in the state. One such act is the Sikkim Online Gaming (Regulation) Act, 2008. This act makes it mandatory for platforms that offer online gaming to have licenses. However, these licenses stipulate that the games may only be played from within the state and may only be made available in designated gaming cafes within the state of Sikkim by intranet gaming terminals.
This means that every platform that wishes to operate from outside Sikkim is virtually excluded. The casinos and other gaming companies operating in Sikkim that use the latest online gaming machines are the ones for which online licenses have likely been obtained in the last 10 years.
The Telangana cabinet approved an ordinance in 2017 that modified the Telangana Gaming Act of 1974 to outlaw online gaming. This had an impact on both online fantasy sports and rummy. Gambling, according to the ordinance, includes any activity that is based on chance, requires payment of money, or rewards a prize. Since this act was passed, Dream11 has been restricted in Telangana, and users in the state cannot enter into cash games.
The Telangana Act reads the same as the Andhra Pradesh Act, as the state was created from a part of Andhra Pradesh in 2014. Many of the guidelines and acts were carried forward, with this act on gambling being one of them.\
