Supreme Court Passes Order On Sourav Ganguly’s Future In BCCI

The Supreme Court has accepted the plea of Board of Control for Cricket in India (BCCI) on Wednesday regarding the mandatory cooling-off period between tenures. It has paved the way for former India team captain and current BCCI president Saurav Ganguly alongside secretary Jay Shah to remain in office.

In its order, the Apex Court has allowed a do-away on the cooling-off period for office bearers across the BCCI as well as various state cricket associations. The officials will not have to go through a cooling-off after one term and will be allowed to serve two consecutive terms at the state and the BCCI levels.

Why did BCCI approach the Supreme Court of India? 

Earlier, as per the BCCI’s constitution, an office bearer had to undergo a cooling-off period of three-year before they could rejoin, at the state association level or the BCCI or both. Citing the issue, the Indian cricket board had filed a plea to the Supreme Court looking for the permission to amend its constitution.

The SC listened to the plea on Tuesday and went on to state that the Indian cricket board is an autonomous body while claiming that the court need not micro-manage its functioning. A judge bench consisting of Hima Kohli DY Chandrachud said, “The submission that the application of cooling off to an individual who has undergone one term at each level (at state unit and BCCI) is stringent. Keeping the reason for which cooling off period was introduced, we are of the considered view that the amendment would not dilute the original objective. We therefore accept the proposed amendment.”

The court allowed amendments to the Indian cricket board’s constitution which effectively allowed Jay Shah to have another term as the secretary. He became an office-bearer in 2013 when he started working at the Gujarat Cricket Association before joining the apex cricket governing council in India as the secretary in 2019.

The Supreme Court’s order shared on Wednesday will see Sourav Ganguly continue as the BCCI president if the former India captain manages to have the backing of state associations. The 50 year old took charge of the Indian cricket board in October 2019.  with his six-year term as an office-bearer ending in 2020 according to the constitution before the ammendment.
