Supreme Court Of India Dismisses SLP For Dream11’s Gambling Case

With regards to a case presented in Supreme Court, a Special Leave Petition (SLP) made Avinash Mehrotra was dismissed by a division bench consisting of Justices BR Gavai and CT Ravi Kumar. The chartered accountant and social activist was in the news after he filed a claim stating fantasy sport games like Dream11 amounted to gambling. His appeal to the Apex law regulatory body of India comes after a decision was passed on it by Rajasthan High Court in October 2020.

The High Court of Rajasthan had stated how winning or losing in a fantasy games by Dream 11 depends on ‘skill and knowledge’ of the participant which was publicly announced in October 2020. Speaking about the GST matter, the Rajasthan High Court referred to a decision made by the Bombay HC and left it upon the authorities to decide.

Similarly, another bench of the Supreme Court issued notices on an appeal which was filed by the Tamil Nadu government. The appeal was filed to challenge the Madras High Court decision that quashed the 2021 amendments of Tamil Nadu Police Act. 

Speaking about the current ongoing appeal, the petitioner had stated how playing on Dream 11 should be considered gambling and that fantasy games are games of sheer chance which results in the player betting on the cricket / sports teams.  The petition was filed in reference to a decision passed by the New York Supreme Court in February 2020.

People have often presented contradicting views on fantasy related sports apps which involve money. Recently, Google had announced that they will launch a pilot which will allow the distribution of rummy applications and daily fantasy sports (DFS) being available on the PlayStore in India. The decision was revealed on 8th September after many industry experts had accused the tech giant of being ‘clearly discriminatory’ and is set to be incorporated onto the PlayStore from 28th September.

Roland Landers, CEO of All India Gaming Federation (AIGF) has claimed it to be a a progressive step that needs to be inclusive. He wet on to share how the category of ‘games of skill’ is broad, with rummy and fantasy gaming not the only two game formats. Landers goes on to insist how poker can also be deemed as a game of skill, which many several High Courts in India have agreed upon.
