Fantasy sports company Dream11 has been in the news since the time tension arose between India and China due to the Sino-Indian border dispute between the two countries. The Delhi High Court has restrained ‘Dream11 team’, from using their logo, which is extremely similar to that of Sporta Technologies Private Limited’s logo. A single judge bench comprising justice Rajiv Shakdher said that the defendant, Dream11 and it’s associates, employees and agents are restrained from using the logo that is similar to plaintiffs trademark.
The High Court also asked Dream11 to take down any content from their social media page that violates the terms mentioned. This came into effect when Sporta Technologies Private Limited filed a plea. As per the plaint, the registration of the trademark ‘Dream11’ was obtained on 28 May, 2009 who also claim that they have been operating a website www.dream11.com.
Sporta Technologies Private Limited is a private company incorporated on 21 June 2007. It is involved in computer related activities like maintenance of websites, creation of multimedia presentations for firms etc. According to the bench, “GoDaddy, LLC is directed to block the domain name dream11team.com.” The bench also mentioned that arraying the website registrar as a defendant to the instant proceedings, asked them to file a reply on the plaint and listen to the issue for further hearing on 6 October.
The plaintiff said that it is aggrieved by the fact that the defendant, Dream11 team has slavishly adopted an identical trademark that has created the confusions. In the past, the company Dream11 had come clean about them being an Indian company. They get their funding from Chinese company Tencent, but Dream11 assured that major shares are owned by Indian companies. Post this issue, BCCI had announced Dream11 as their title sponsor.
